Terms of Service

The deal between you and NIKS GAMES LLC when you play Capital Rift or buy a Player Pass.

In the EU, EEA and UK you have 14 days to withdraw from a Player Pass and get your money back, no reason needed, straight from your account page (section 4).

The one to actually read: this is a closed beta, so it can break, go down, and have its game progress wiped (section 5).

1The agreement

Capital Rift is operated by NIKS GAMES LLC, a Nebraska limited liability company ("we", "us"). By signing in or buying a Player Pass you agree to these terms. If you do not agree, do not use it.

How we handle your data is covered separately in the Privacy Policy, which is part of this agreement.

Nothing here takes away rights you have by law as a consumer that cannot be signed away.

2Your account

3The Player Pass

The Player Pass is a one-time payment, not a subscription. There is nothing recurring and nothing to cancel. It buys:

The price is shown before you pay and may change for future buyers. Paying early does not entitle you to a refund if the price later drops.

The Pass is a personal licence to access the game. You are not buying property, an investment, a share of anything, or any in-game item as an asset. In-game money, buildings and goods have no real-world value, cannot be exchanged for money, and can be changed or removed as we balance the game.

Capital Rift is planned to be free to play when it launches. The Pass buys early access and the launch perks above, not the game itself.

4Withdrawal and refunds

If you live in the EU, the EEA or the UK you have 14 days to withdraw from a Player Pass, without giving a reason. You can do it yourself, in two clicks, from your account page.

The Pass is access to a live online world that we run, change and update. That makes it a digital service rather than a fixed file you download, and the 14-day right of withdrawal applies to it. We used to say the Pass was non-refundable because your access unlocks instantly. That was wrong, we have corrected it, and this section replaces it.

Who has the right

Anyone buying as a consumer who lives in the European Union, the European Economic Area, or the United Kingdom. It comes from Article 9 of Directive 2011/83/EU, and in the UK from the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

How long you have

14 days, starting the day you buy. Your exact deadline is printed on your account page, so you never have to count.

If you bought through our earlier checkout, the one that wrongly told you there was no right of withdrawal, your window is longer: 12 months and 14 days from your purchase. You do not have to work out whether that is you. Your account page shows your real deadline, says when it is the longer one and why, and the button works right up to it. We are not going to make you find that out by asking.

How to do it

You do not have to give a reason, and we will not ask you for one.

The model withdrawal form

The law asks us to hand you a standard form you can use to withdraw. Here it is. You never need it, the button and a plain email both count just the same, but it is yours if you want it. Copy it into an email to support@capitalrift.com:

What happens then

When you buy, you ask us to unlock your access immediately rather than waiting out the 14 days. That is what the tick box at checkout is for. It means that if you then withdraw, we are entitled to keep a proportionate amount for the access you already had. In practice we do not charge it: self-serve withdrawals inside your window are refunded in full. We are telling you the right exists because the law says you should know it, not because we plan to use it.

Doing it more than once

The one-click button covers one withdrawal per account. If you buy again and want to withdraw again, that right still exists, but email support@capitalrift.com and a person will handle it.

Everywhere else

Outside the EU, EEA and UK there is no statutory withdrawal right, so the Pass is non-refundable as a rule. Read the next paragraph anyway.

When we refund regardless

None of the above stops us refunding you if we think it is the right thing to do. Write to support@capitalrift.com and tell us what happened. We will actually read it. In particular we are not going to keep your money if you were charged twice, if you were charged and never got access, or if something on our end broke badly enough that you never really got what you paid for.

Capital Rift is an unfinished game in closed beta, run by a very small team. Being honest about what that means:

We can remove content and suspend or terminate accounts that break these rules. For anything short of a serious or repeated breach we will normally warn you first.

How moderation actually works here

The Digital Services Act says we have to tell you what tools we use to moderate, including anything automated. So, in full:

Reporting illegal content

If you believe something here is illegal, rather than just against the rules, there is a dedicated form: capitalrift.com/report. You do not need an account to use it and you do not have to give your name. You get a reference number back, and if you leave us a contact address we tell you what we decided either way.

Ordinary rule-breaking, bugs and someone being unpleasant are better sent to the in-game boards or support@capitalrift.com, which is faster.

If we find something suggesting a criminal offence that threatens someone's life or safety, we report it to the relevant authority immediately.

Contacting us, and authorities contacting us

For everything, including formal contact from a regulator or law enforcement, the address is support@capitalrift.com, and it reaches a real person. You can write in English. We are NIKS GAMES LLC, Omaha, Nebraska, United States.

7Your content

You keep ownership of what you post. You give us permission to store, display and distribute it inside Capital Rift so the game can function, and to quote bug reports and suggestions while we work on them.

Edits you make to the shared world become part of that world for everyone, and stay there if you leave. Everything else you post is covered by the deletion rules in the Privacy Policy.

The game, its code, art, and the Capital Rift name are ours.

8Ending it

You can delete your account at any time from the account screen. Read what deletion does and does not remove first. Deleting your account does not by itself refund a Player Pass.

If your 14-day withdrawal window is still open, withdraw first, then delete. Deleting does not take the right away, but it does unhook the button, and you would have to email us instead.

To be explicit, because it would be a nasty surprise otherwise: deleting your account does not end a withdrawal right you still have under section 4. If you delete inside your window and then want your money back, write to support@capitalrift.com from the address you bought with and we will refund you. We keep the purchase record precisely so we can still find you.

We can suspend or terminate your account if you break these terms. If we terminate you for a serious breach, you do not get a refund.

If we shut Capital Rift down, we will announce it in the game and by email with as much notice as we reasonably can.

9Warranties

Capital Rift is provided "as is" and "as available". Beyond what the law requires us to provide, we do not warrant that it will be uninterrupted, error free, secure, or that any defect will be fixed.

If you are a consumer, your statutory rights are unaffected by this section.

10Liability

To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, or lost in-game progress.

Our total liability to you is capped at what you have actually paid us in the 12 months before the claim, which for almost everyone is the price of one Player Pass.

Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

11Governing law

These terms are governed by the laws of the State of Nebraska, United States, without regard to its conflict of law rules. The state and federal courts located in Douglas County, Nebraska have exclusive jurisdiction, and you and we both consent to that venue.

If you are a consumer in the EU, the EEA or the UK, this does not deprive you of the protection of the mandatory consumer law of the country you live in, and you can bring proceedings in your local courts.

12Changes

We may update these terms. The date at the top changes, and if a change is significant we will tell you in the game. Continuing to play after a change means you accept it. If you do not accept it, delete your account, and if your withdrawal window is still open, withdraw first (see section 4) so you are not out of pocket for terms you did not agree to.
